1.  GENITALIA OVER GENDER: A COMPARATIVE HUMAN RIGHTS ANALYSIS OF U.S. AND U.K. LAWS REGARDING THE TREATMENT OF TRANSGENDER PRISONERS ~ by Kimberly Shindel Gender & Sexuality in Human Rights Law Spring 2011 (Sexual Minorities & HIV Status)
Many individuals in the United States struggle with understanding the difference between sex and gender. The two terms are often conflated, and many simply assume that gender of the American public that simply has no idea how to comprehend?much less accommodate? transgender individuals. One of the most dire consequences of this takes place within the U.S. prison system, where transgender prisoners are subject to a host of abuses and degradations. Few housing facilities in the detention system have any sort of policy for how to respond to the needs of transgender detainees or prisoners?particularly for those who are have not yet undergone any sex reassignment surgery. By being invisible to the system at large, they are exposed to a host of violations of their rights. <br><br> This paper aims to identify some of the internationally recognized human rights that are violated within the U.S. prison system prisoners. These rights? articulated in treaties, cases, papers, principles, and declarations- treatment and lack of accommodation given to transgender prisoners. Two main areas are of particular focus: the lack of access to necessary transformative medical procedures and the practices used in placing transgender inmates.

China created several laws and policies over the last two decades designed to find this balance between right-protection and health-protection. Unfortunately, many of the laws are unenforceable due to conflicting laws and other barriers in the legal system.3 Consequently, Chinese law both allows and engages in discriminatory behavior which, directly and indirectly, violates many international human rights that the Chinese government is obligated to protect.

3.  Turkish nationalist tabloid attacks gays as (Sexual Minorities & HIV Status)
The article insinuates that METU students are in constant fight with ?generally accepted norms of society?, making dance performances with "dirty figures" and "deviants" from the LGBT rights organization Kaos GL. <br><br> In a sense it portrays the students as being irresponsible and morally corrupt by associating them with gays and LGBT rights organizations branded as "deviants". <br><br> The paper also alleges that METU is LGBT friendly, while in reality its administration banned students from having official women and LGBT groups. <br><br> According to KAOS GL, the university?s administration previously made comments such as ?there are no women at our school, only girls? and ?our students don?t need a sexual club [in reference to LGBT rights]?. <br><br> It is not the first time that Yeni Akit used hate speech against LGBT community.<br><br> In 2008, when Kaos GL invited an Turkish MP for its International Anti-Homophobia Meeting, the paper accused the politician for ?being on the side of deviants?.

Similarly, the Bill threatens to punish or ruin the reputation of anyone who works with the gay or lesbian population, such as medical doctors working on HIV/AIDS, Civil Society leaders active in the fields of sexual and reproductive health; or even religious leaders providing guidance and counseling to people who are unsure of their sexuality or any other consultations. There are claims that the bill has been watered down, however we reiterate our position that we condemn this bill in its entirety.  <br><br> The existing law has already been employed in an arbitrary way, and this Bill will just intensify that effect. Since it?s first reading, increased campaigns of hate have continued uncontrolled. The violence directed at homosexual Ugandans has resulted in the unwarranted arrests of many people and closure of educational workshops for LGBT persons. We have documented about 17 cases in and outside various courts all over Uganda. These acts of violence have now resulted in murder and suicide of LGBT Ugandans. SMUG?s Advocacy and Litigation Officer David Kato who was brutally murdered at his house in January 2011.

Last year, Immigration Equality won asylum for now 25-year-old Korey Chisholm of Guyana, an English-speaking South American country hostile to gays. Chisholm was an AIDS activist who was infected with HIV after being brutally raped at 16. He entered the United States on a tourist visa last year and now lives in Brooklyn and works in a retail store. He is still involved in social justice organizations. <br><br> Chisholm was constantly taunted as a child for appearing effeminate and routinely denied access to public transportation because other passengers were not comfortable having a gay person ride with them. Later, as a UNAIDS Fellow, he was treated well by colleagues, but shunned in any other setting. "Getting transportation or just walking down the street for someone who is flamboyant or openly gay was very difficult," Chisholm said. <br><br> "Religious values play an important role in our country and the law is not as important as the Bible," he said. "If you are caught in the act, you face imprisonment and no one can help. You can't go to the police." Chisholm has been robbed and he has gay friends who have been beaten. Even being HIV positive, he was given no access to medicines until he arrived in the United States.

The Nigerian Senate has passed a bill that criminalizes homosexuality, forcing even families to report their loved ones if they are in same-sex relationships. Its House of Representatives will soon vote on it.<br><br> "It has huge implications," said Oliver, who is now 26 and living in the Queens section of New York City. "It will actually make families torn apart and open the doors to persecution of those even perceived to be gay." <br><br> Under the proposed criminal code, Oliver could be sent to jail for 14 years. If enacted, the law would also penalize any organization that provides services to lesbian, gay, bisexual or transgender citizens.<br><br> Oliver is one of 102 LGBT applicants to win that status in the United States, thanks to the pro bono work of Immigration Equality. They come countries like Jamaica (31) to El Salvador (6) to Russia (7). <br><br> The situation is particularly dire for these people, who are subject to false arrest, loss of employment, extortion, attacks and sometimes death.

16 November 2012 ? The United Nations human rights office today expressed its concern over reports of people in Cameroon being harassed, intimidated, arrested and imprisoned because they were suspected of being lesbian or gay ? and called for an end to such practices. <br><br> Article 347 of the current penal code in the country criminalizes ?sexual relations with a person of the same sex? and provides for a penalty of up to five years imprisonment and a fine, according to the Office of the UN High Commissioner for Human Rights (OHCHR). <br><br> Addressing a news conference in Geneva today, an OHCHR spokesperson, Rupert Colville, said that the law breaches Cameroon?s international human rights commitments and violates rights to privacy and to freedom from discrimination. <br><br> "While the penal code relates specifically to sexual conduct, we are seriously concerned that it is being applied in a broad-brush way to prosecute many individuals on the basis of their appearance, their mannerisms, style of speech or general conduct," Mr. Colville said. <br><br> He noted that OHCHR calls for an end to the arbitrary arrest and detention of all persons suspected of homosexual behaviour, as well as access to justice for those already detained.

You are a man and you married a man and yet you want to adopt someone?s? child. We will not tolerate this act of life in this country.? <br><br> Speaking in crude terms he added ?We will not lock homosexuals in one cell, but one to a cell and if you want, you can do it with the wall.? <br><br> This latest attack on the gay community come less than two weeks after 18 people, including Gambians, Senegalese and Nigerians were arrested and charged with indecent practices after being ?suspected of homosexuality? and according to the charge sheet ?Conspiring to engage in an indecent act contrary to the laws of the Gambia.? <br><br> Same-sex sexual relationships are punishable by up to 14 years imprisonment in the Gambia.

Right now in Iraq, young people "perceived as gay" because of how they dress, or what music they listen to, are being targeted, tortured and killed by extremist militias. Youth with a modern "emo" style are being especially singled out. <br><br> Our friend Bissam*, a gay Iraqi refugee and a member of All Out, told us that these militias are creating ?kill lists?, that include men whose hair was too long or whose jeans were too tight, or women deemed overly "masculine." Human rights groups and Iraqi news are reporting that 40 to 90 Iraqis have been brutally murdered in just the last two months.

BANJUL - Gambian police arrested fifteen men "suspected of homosexuality" at a bar in a suburb of the capital Banjul, police sources told AFP on Tuesday. <br><br> The men, all Gambians except one Senegalese, were arrested late Monday when police raided a bar in a popular tourist area. Officers had received a tip of people "publicly displaying or promoting homosexual activities," a senior police officer speaking on condition of anonymity told AFP. <br><br> Homosexuality is banned and men or women in same-sex relationships can face up to 14 years in prison. <br><br> Gambian President Yahya Jammeh has repeatedly denounced homosexuality and in 2008 he even vowed to behead gays, a threat he later retracted.

Attacks against gays have climbed steadily for most of the last decade, with 272 murdered in 2011?one every 36 hours, according to Grupo Gay da Bahía, a leading gay-rights group that tracks antigay violence. This year, GGB reports, it?s even worse, with 75 murders in just the first 10 weeks. That?s one every 24 hours.

Several LGBT people were left to die in the rubble after houses and buildings collapsed, explains Reginald Dupont, a manager at SEROvie. Even those LGBT people who survived faced spontaneous blame and persecution; radio sermons, church talks, word of mouth, and general discussions in the street targeted LGBT people as "sinners" who had called the earthquake upon the country by angering God. "After [LGBT people] were taken out of the debris, they had to get out of the immediate area as soon as possible so as not to attract anger," explains Dupont. <br><br> The scapegoating and persecution took several forms documented in the report, including physical violence against LGBT people in the camps where displaced people were living (and where half a million people continue to live), and sexual violence, including so-called "corrective rape." Corrective rape is a phenomenon that has garnered significant media attention in South Africa, among other countries; it is a crime in which rapists attempt to justify their acts by purporting to "correct" their victims' same-sex identities and acts. <br><br> Despite losing its community meeting space and 14 members to the earthquake, SEROvie has forged ahead. Nonetheless, SEROvie's Dupont notes that LGBT people "will be the last people [the government] will think about," urging that international humanitarian agencies ensure that their assistance be distributed equitably and in an inclusive manner. Johnson concurs: "Disasters are going to happen. Gay people fare worse, and gay people recover the slowest. We are completely invisible and forgotten."

"The International Gay and Lesbian Human Rights Commission has today received reports from Iraq of a wave of targeted killings of individuals who are perceived to be gay or lesbian. According to Iraqi human rights activists, in early February 2012, an unidentified group posted death threats against ?the adulterous individuals? in the predominantly Shiite neighborhoods of Baghdad and Basra. The threats gave the individuals, whose names and ages were listed, four days to stop their behavior or else face the wrath of God, and were to be carried out by the Mujahedin. According to sources inside Iraq, as the result of this new surge of anti-gay violence close to 40 people have been kidnapped, brutally tortured and murdered. The Iraqi authorities have neither responded to this targeted violence nor have they publicly denounced it. It is widely believed that these atrocities are being committed by a group of the Shiite militia."

Crímenes sin resolver <br><br> -Mayo de 2011.- Fue encontrada sin vida Bárbara Lezama, transexual asesinada a golpes en su domicilio ubicado en el municipio de Cuautlancingo, por un sujeto que no fue detenido. <br><br> -Diciembre de 2011.- Un profesor de la BUAP fue torturado y asesinado en su domicilio. Robaron un vehículo que no ha sido recuperado y los agresores siguen libres. <br><br> -Enero de 2012.- En la colonia del Valle de Puebla, un homosexual fue asesinado a puñaladas. Para entorpecer las investigaciones, los agresores intentaron incendiar el domicilio. <br><br> -Febrero de 2012.- Las autoridades encontraron un cuerpo descuartizado; días después se supo que se trataba de un menor de edad homosexual. También se obtuvo la identidad del agresor que presuntamente huyó a Oaxaca y no ha sido capturado.

BERLIN, March 4 (Reuters) - Belarussia's Alexander Lukashenko on Sunday criticised EU politicians who have threatened him with further sanctions and in an apparent reposte to the German Foreign Minister's branding him "Europe's last dictator", said: "Better to be a dictator than gay." Guido Westerwelle is Germany's first openly gay minister. European Union leaders at a summit in Brussels on Friday called for new measures to pressure the Belarus President, in power since 1994, over alleged human rights abuses. Lukashenko said Belarus would give a strong reaction to any sanctions, according to local news agency Belta. "This is absolute hysteria," Belta reported him as saying. "And as you can see, at the forefront there are two types of politicians ... one lives in Warsaw, another in Berlin."

Frente a su casa de habitación fue asesinado de varios garrotazos el joven Eddy Napoleón Ramírez Novoa, de 27 años, en el reparto Salomón de la Selva. Los presuntos implicados en el crimen son los hermanos Milton Rafael (36), alias ?Payo?; José Ramón (32) y Oscar García López (25). <br><br> De igual manera Julio César Largaespada, quien era pareja de la víctima, resultó garroteado y producto de las heridas fue trasladado al Hospital Escuela Oscar Danilo Rosales Argüello (Heodra). <br><br> Según Largaespada, los hermanos García López empezaron a ofender a la víctima diciéndole que era un "cochón" y posteriormente iniciaron una riña. Los hermanos se armaron de palos y empezaron a golpear a Ramírez en la cabeza, hasta desprenderle uno de los ojos. Horas más tarde falleció en el Hospital de León. <br><br> ?Desde hace un año veníamos denunciando ante las autoridades de la Policía de León esta situación, a tal punto que fue llevado el caso a los Tribunales de Justicia, sin embargo la fiscal Flor de María Rostrán nunca atendió el caso, hasta que se dio la tragedia?, dijo Largaespada. <br><br> ?Recuerdo que cuando estaban golpeando a Eddy hice más de cinco llamadas a la delegación policial del reparto Rubén Darío y el oficial que me atendió me dijo que no quería tener problema, hasta que me mataron a Eddy…?, expresó el sobreviviente.

The Minister for Ethics and Integrity, Simon Lokodo, who was accompanied by police, announced that the workshop was illegal and ordered the rights activists out of the hotel where it was being held. He told activists that if they did not leave immediately, he would use force against them. <br><br> ?This is an outrageous attempt to prevent lawful and peaceful activities of human rights defenders in Uganda,? said Salil Shetty, Amnesty International's Secretary General.<br><br> The Minister also attempted to order the arrest of Kasha Jacqueline Nabagasera, a prominent LGBT rights activist and winner of the 2011 Martin Ennals Award for Human Rights Defenders, who was forced to flee from the hotel. <br><br> The reasons for the attempted arrest were not immediately clear, but were reported to be linked to Kasha Jacqueline's attempt to challenge the Minister's actions. ?The Government of Uganda must protect all people against threats, violence and harassment irrespective of their real or perceived sexual orientation or gender identity. <br><br> The move comes days after the Anti-Homosexuality Bill was re-tabled in the Ugandan Parliament. The Government of Uganda has sought to distance itself from the Bill, stating that the bill did not enjoy government support.

LGBT persons were subject to societal harassment, discrimination, intimidation, and threats to their wellbeing during the year. Individuals openly threatened members of the LGBT community and their constitutional rights during several public events. For example, on April 15 in Jinja, Pastor Martin Ssempa led a march against homosexuality, and during an April 17 event against homosexuality at a church in Kampala, Ssempa showed a pornographic slideshow to audience members, which included several children. During these rallies participants openly threatened LGBT individuals. In its annual report for 2009, released in October 2010, the UHRC determined that the draft antihomosexuality bill violates the Ugandan constitution and international law.
