1302. Egypt: Fear of arrest results in Egyptian gays not having HIV tests-By Pink News-04/04/06-http://www.pinknews.co.uk/news/articles/2005-1032.html/ (Sexual Minorities & HIV Status)
This document was provided by Immigration Equality, New York, NY

In 2001, a number of men were arrested by police following a raid of a Cairo gay meeting point and information recorded from gay websites have resulted in numerous raids in recent years.
"It won't change a thing," a man who did not wish to be named told the Reuters news agency. "The Egyptian government wants to pretend gays don't exist, not help them. People like to believe that this is an Islamic society, therefore, there are no gays.
The man told reporters that he self identified as bisexual but that he would eventually marry a woman. He claimed to have been undergone regular HIV tests but said that most of his gay and bisexual friends did not and that they often had unprotected bareback sex.
"Some think that if you only see Egyptians you won't get AIDS, or that if the whites of their eyes are very clear, they don't have HIV," he said, adding that many prostitutes consider westerners to be HIV-free and therefore do not require the use of a condom.

1303. Egypt: In the Fight Against AIDS, The World Cannot Afford Discrimination-By San Francisco Bay Time-04/17/08-http://www.sfbaytimes.com/?sec=article&article_id=7935 (Sexual Minorities & HIV Status)
This document was provided by Immigration Equality, New York, NY
<brThis week an Egyptian court sentenced four men each to three years in prison because they are gay and HIV-positive. Taken into custody during a sweep of recent arrests of suspected homosexuals, the men were publicly shamed, forced to submit to HIV tests, and tortured by Egyptian authorities. This type of treatment not only violates international human rights standards, it undermines efforts to prevent the spread of HIV/AIDS.
Around the world, stigma, discrimination, and lack of access to health services have sparked alarming HIV epidemics among men who have sex with men, or MSM. Ironically, it was gay men in the United States and Europe who first brought AIDS into the global spotlight, forcing the issue into the public consciousness during the 1980s. These impassioned advocates fought for increased research funding, access to treatment, and a seat at the decision-making table, and they largely succeeded in slowing the spread of the epidemic in their communities.

The mob moved with the police to the station which is where they still are."

Federal Penal Code

Article 354 of the Federal Penal Code states, "Whoever commits rape on a female or sodomy with a male shall be punished by death." While English translations of the Arabic text are in some dispute, it is generally felt that this is a prohibition against rape, and possibly consensual sodomy.

The Federal Penal Code does not replace the legal system of each emirate, unless it is contrary to the federal law, and thus Sharia law remains in place. Hence a person could be charged on this federal penal code, or under a local (emirate) penal code.

This document was provided by Immigration Equality, New York, NY

Although the Nigerian Same Sex Marriage Bill of 2006 appears to be at least temporarily shelved, no one knows if and when it will reappear. For the moment the focus is on another proposed ?morality? legislation, the Dress Code Bill sponsored by Senator Eme Ekatte, Chairperson of the Senate Committee on Women and Youth Affairs. At first glance her logic is beyond belief but when looked at in the context of the fundamentalist religious movement led by Bishop Akinola on the one side and Sharia advocates on the other, is it really so surprising? What we have is a country of Jekyll?s and Hyde?s, obsessed by religion and morality one minute and condoning infidelity and silent on sexual and physical child abuse, the next. Despite the wide condemnation of the Bill in the press, reading between the lines there is still the widely held belief that women and girls are the seducers of men.
