"Abtract:<br>
Abstract
The Islamic Republic of Iran punishes homosexuality with death but it actively recognizes
transsexuality, and partially funds sex change operations. This article aims to examine how this
seemingly progressive stance on transsexuality is connected to the IRI?s larger oppressive appara-
tus of gender. It will ?rst provide an overview of the cultural politics of gender and sexuality under
the Islamic Republic?s rule, and will then discuss the con?uence of religious and medical litera-
tures that led the Islamic Republic to adopt its new discourse on transsexuality despite ? or perhaps
rather because of ? its sex/gender politics. The article does not deny that this emerging discourse
has been somewhat empowering for those transsexuals who genuinely desire surgical transforma-
tion. But empowering as it might have been for such transsexuals, the emerging discourse is still
deeply troubling since it systematically regards homosexuality and more generally any sexual or
gender non-conformity as unintelligible, perverse, and punishable by law, except for those willing
to transform their ?wrong bodies.? The article will, therefore, demonstrate that the IRI?s permission
of transsexuality and sex change operations is motivated by a goal that is more about assimilat-
ing gender atypical individuals into the heteronormative order than about broadening horizons for
sex/gender possibilities. The article ends by discussing how this discourse is making non-surgical
trans/multi-gendered identity illegible and illegitimate not only as a publicly recognized possibil-
ity, but also with regard to transpersons? own self-perception and self-constitution of their gender
and sexual subjectivity."

But India's judicial system moves at a glacial place and its judges have a tendency to choose deferment over decision when the verdict might be troublesome. So the country's gay community may have to wait another eight years before it is truly safe to come out of the closet."

"Homosexuality was illegal. The penal code makes it an offense punishable by up to five years in prison to have carnal knowledge of any person of the same sex. The law in Zanzibar establishes a penalty of up to 25 years' imprisonment for men who engage in homosexual relationships and seven years for women in lesbian relationships. There were no reports that anyone was punished under the law during the year. Homosexuals faced societal discrimination.<br><br>
The Tanzania Parliamentarians' AIDS Coalition addressed discrimination against persons infected with HIV/AIDS. However, there were reports that discrimination in housing, healthcare, and education continued to occur against the estimated 1.4 million persons in the country living with HIV/AIDS. The government, working with NGOs, continued to sensitize the public about HIV/AIDS-related discrimination and to create safeguards for HIV/AIDS patients' human rights. A network of lawyers, policymakers, and doctors continued lobbying efforts and other activities to deal with legal, ethical, and human rights problems associated with HIV/AIDS."

"Research findings confirmed that male-male sex occurs in Togo. 51% of the participants had been tested for HIV and 67% could cite two or more modes of HIV prevention, but only 21% reported systematic condom use. Participants judged their HIV risk as the same or lower than the general population, based on the belief that HIV is contracted from sexual encounters with women."

"...My advice is that it's not 'African' to be gay, the teacher replied, using a slur for the term. 'Ignore those feelings and try girls.' She also apparently gossiped with colleagues. Other teachers started teasing Gurirab, asking him why he didn't play soccer and why he spent so much time around his mother. Then one morning, he said, the gym teacher invited him into his office, locked the door and forced him onto the desk for sex. 'Let's see how good you are at it,' the teacher said, according to Gurirab, now 25, who recounted the story through tears. The ordeal left his legs and arms with red bruises. The next day, distraught and confused, he had sex with a female classmate. 'I wanted to change so badly and not be gay . . . but I couldn't,' he said.
'I knew I liked men. I decided I would kill myself. . . . I was so desperate I called a lifeline in London. They saved my life.'"<br><br>
"Treatment of gays, group members said, ranges from social ostracism to physical attacks. In rural Namibia, they found, about 80 percent of gay men and lesbians were forced to marry and have children. In many countries, gay people were often depressed and reported having covert same-sex relations outside heterosexual marriages."

As a result of the Act, condoms are not being distributed in Namibian jails: to do so would amount to condoning sex between men in contravention of the law, says the government, even if it had the benefit of reducing HIV transmission. 'By giving them [prisoners] a condom, you are telling them to go ahead and do it,' says Ignatius Mainga, a spokesperson for the ministry of safety and security's prison services"<br><br>
"However, he is of one mind with other campaigners in believing that prisons are a breeding ground for HIV, and that condoms would help curb the Aids pandemic in Namibia's jails. 'In cases where it is consensual, whether inside or outside of prison, the state has to allow consenting adults o make their choices,' says Tjombe. ? IPS"
