Fighting Stigma and Discrimination against People Living with HIV and AIDS in the Philippines- www.hurights.or.jp 09/30/06 (Sexual Minorities & HIV Status)
While the Philippines is considered a "low prevalence" country for HIV and AIDS, the presence of risks and vulnerabilities among Filipinos (due to low condom use, liberal view on sexual practices leading to multiple partners, lower sexual debut among youth) made the Philippine civil society and partners more vigilant against a "hidden and growing" HIV epidemic that lurks behind this stark reality.<br><br>
Research on stigma and discrimination against PHAs<br>
RAF, in partnership with Pinoy Plus Association and Deakin University in Australia, published in 2003 a report on the situational analysis of HIV/AIDS-related stigma and discrimination in the Philippines. The report focused on institutional forms of discriminatory practices in Metro Manila. One significant finding shows that most of the discriminatory practices occur in the health care setting as compared to incidents in other areas of social life (housing, welfare, justice system, finance and insurance, livelihood, prison, reproductive health and family, and public accommodation). This is probably due to the fact that most of the PHAs access the health services more often than the other areas. The research was very enriching and needed to be followed up to ensure that stigma and discrimination issues related to HIV are addressed accordingly.

Philippines: Discrimination and stigma continue to haunt HIV-AIDS patients, kin- www.ippf.org 01/02/08 (Sexual Minorities & HIV Status)
A family woke up to the blaze of fire engulfing their tiny hut in a remote village near Olongapo City. their neighbors allegedly colluded to torch their house amid fears of getting infected by HIV (human immunodeficiency virus) that one of the members of the family had carried. HIV is the virus that causes AIDS (acquired immune deficiency syndrome). <br><br>She says the arson episode is a clear manifestation that despite the law that aims to protect the rights of known and suspected HIV-infected persons, discrimination and stigma continue to haunt them and their family. And this is primarily the reason why AIDS prevalence in the Philippines, ?though growing, is hidden."

Philippines: HIV discrimination: An analysis of the situation in Manila - Int Conf AIDS 2004 Jul 11-16; 15:(abstract no. WePeE6904)- http://www.aegis.com/ 07/16/04 (Sexual Minorities & HIV Status)
CONCLUSIONS: The written legal situation in the Philippines with respect to protecting people living with HIV/AIDS against discrimination is sound. Unfortunately, in the areas of institutional practice the legislation have not had sufficient impact. This is particularly stark in the areas of health care, housing and insurance. For the legislation to become more effective, there needs to be targeted campaigns to make people in positions of practice aware of their legal (and humanitarian) responsibilities.

Preconcepto contra personas LGBT todavía es elevado en Brasil - Preconceptions against LGBT people still high in Brazil- www.adital.com.br- 02/11/09 (Sexual Minorities & HIV Status)
Degrees of intolerance against sexual diversity continue quite high in Brazil, which is understandable given the probable first place position Brazil occupies in homophobic crimes. The study "Sexual Diversity and Homophobia in Brazil: Intolerance and respect of the sexual differences," carried out by the Center for Public Opinion of the Perseu Abramo Foundation, in cooperation with the German Rosa Luxemburg Stiftung (Foundation), shows numbers which confirm the statement given above.

Stop the Violence - Live Updates from South Africa - HRW 02/11/09 (Sexual Minorities & HIV Status)
On April 28, 2008, Eudy Simelane, 31 years old, was gang-raped and brutally murdered in her home township, Kwa-Thema, in the East Rand near Johannesburg. The apparent motivation for her killing was that she was a lesbian who fought back "like a man."<br><br>
South Africa has one of the highest rates of violence against women in the world. Amid the general crisis of sexual assault, women who are identified as lesbians or who don't conform to cultural or social norms for what women "should look like" or how women "should act" have also been targeted.<br><br>
Eudy Simelane's murder shocked the Kwa-Thema community. It was long known as a tolerant and open township, a place where lesbian and gay life had been visible and free. Her death seemed to symbolize the collapse of that open space into violence and patriarchal prejudice.

According to two international non-governmental organizations, sexual relations between members of the same sex are prohibited and are punished by imprisonment (AI July 2006; ILGA Nov. 2006, 3). Article 9 of the Sexual Offences Act of 1992 states that a person who commits "buggery" is liable to imprisonment for life (Barbados 13 Feb. 1992; World Policy Institute Dec. 2003, 74; Ottosson 2006, 3). Article 12 of the Sexual Offences Act sets out that a person who commits an "act of serious indecency" or who incites another person to commit such an act is liable to imprisonment for 10 years if both parties are at least 16 years of age (Barbados 13 Feb. 1992, Art. 12; Ottosson 2006, 3; World Policy Institute Dec. 2003, 74).

Ecuador: Protest Workplace Discrimination; Demand Effective Implementation of Constitutional Protection Against Discrimination- IGLHRC- 08/30/08 (Sexual Minorities & HIV Status)
SUMMARY <br><br>
On July 1, 2004, Alex Franco Acebo was fired from Invescol, a private security company in Guayaquil, Ecuador. He had worked for the company for two years. According to Invescol Manager, Mr. Franklin Gallegos, the company?s internal regulations bar the employment of "physically disabled people and gays."<br><br>
In 1997, Ecuador was the first in Latin America (and the second in the world, following South Africa) to include specific protection against discrimination based on sexual orientation in its Constitution. In this context, the action of Invescol, especially Mr. Acebo?s sexuality, are irrelevant to his job performance and should not, in any context, be compared to a "physical deficiency" that might render him unable to perform his job properly.<br><br>
Indeed, while Invescol?s position is impossible to justify, the consequences of their policy are dramatic and conclusive: Alex Franco Acebo is currently unemployed, and is thus unable to attend to his basic survival needs, lacking any support if he happens to fall ill. In this context, if the government of Ecuador does not take action against Invescol, they will have failed to protect and fulfil Mr. Acebo's rights to be free from discrimination and his right to work. Fundación Amigos por la Vida (FAMIVIDA), a local LGBT Rights and HIV/AIDS prevention group, has submitted a complaint against Invescol to the Ecuador?s Labour Ministry.

Intolerance sets back the fight against AIDS; In Senegal, a crackdown on 'MSMs' - homosexuals - threatens to undo the recent success gained by a group combatting the disease - INTERNATIONAL NEWS; THE AFRICAN AIDS EPIDEMIC; Pg. A14- By STEPHANIE NOLEN, snolen@globeandmail.com- 06/03/08 (Sexual Minorities & HIV Status)
After the newspaper story, Ceri, a founder of the first MSM organization, was at the
top of the "public enemies" list. He was fired from his job; his partner left him in
terror at also being identified. Ceri had already been banished by his family eight
years before when he began his HIV-education work and told them he had male
partners, so he couldn't seek shelter there.<br><br>
"Some people fled the country, and some went into hiding," he said. He has slept in a
different place each night in the months since the furor began. "At first I was
paralyzed with fear, but the media say I have left the country, so at least now I can
move around a little."

Senegal: Persecuted in Africa, a Refugee Finds His Way - by By KIRK SEMPLE and LYDIA POLGREEN, The New York Times 10/06/08 (Sexual Minorities & HIV Status)
Though Senegal passed an antisodomy law in 1965 that forbids 'an improper or
unnatural act with a person of the same sex,' homosexuality has traditionally been
quietly tolerated in Senegal, particularly among the creative class of musicians and
artists that is so central to Senegalese culture.<br><br>
But the publication of the gay wedding photos on Feb. 1 dovetailed with a recent
surge in anti-gay sentiment, a trend partly fueled by some conservative Islamic
leaders, sending Mr. Mbaye on his harrowing odyssey.
