Other Societal Abuses and Discrimination<br><br> Societal discrimination against persons with AIDS existed, most often in the form of a psychological stigma associated with rejection by family, friends, and the community, although intensive educational outreach efforts may have reduced this stigma in some communities. There were reports that some employers refused to hire persons who tested HIV-positive following employer-mandated blood screening. NGOs complained that employers discriminated against male homosexuals after reviewing military documents that permanently labeled these individuals as having a mental disorder. According to the military, as many as 500 individuals every year were affected by the practice, which reportedly stopped in April. NGOs estimated that at least 10,000 individuals had been affected by the army regulations nationwide. The law did not permit transgendered individuals from changing their gender on identification documents.

Other Societal Abuses and Discrimination<br><br> There was no evidence of official discrimination against persons with HIV/AIDS, but societal discrimination against such persons existed. There were credible reports that persons with HIV/AIDS lost jobs or suffered from discrimination in the workplace or in finding housing, although such reports decreased. In a few cases, children of persons with HIV/AIDS were barred from schools, despite its being against the law. With the assistance of foreign donors, the national government and provincial authorities took steps to treat, assist, and accommodate persons with HIV/AIDS; decrease societal stigma and discrimination; and increase dignity; however, overall consistency was lacking. Religious charities were sometimes permitted to operate in this area. A homosexual community existed but was largely underground. There was low public awareness of the issue and little evidence of discrimination based on sexual orientation.

Other Societal Abuses and Discrimination<br><br> Over a period of years, President Mugabe publicly denounced homosexuals, blaming them for Africa's ills. Although there was no statutory law proscribing the activities of homosexuals, common law prevents homosexual men, and to a lesser extent, lesbians, from fully expressing their sexual orientation and, in some cases, criminalizes the display of affection between men. In July 2006, the 2004 amended criminal code became effective, broadening the definition of sodomy to include "any act involving physical contact between males that would be regarded by a reasonable person to be an indecent act." The government had a national HIV/AIDS policy that prohibited discrimination against persons living with HIV/AIDS, and the law aims to protect against discrimination of workers in the private sector and parastatals. Despite these provisions, societal discrimination against persons affected by HIV/AIDS remained a problem. Although there was an active information campaign by international and local NGOs, the Ministry of Health, and the National AIDS Council to destigmatize HIV/AIDS, ostracism and condemnation of those affected by HIV/AIDS continued.

La Conferencia Episcopal Ecuatoriana (CEE) planteó hoy a la Asamblea Constituyente que reconozca los derechos que otorga la Ley a las 'parejas estables, sin que importe su sexo u opción sexual', aunque ratificó a la práctica homosexual como 'incompatible con la vida de fe'. <br><br>Puntualizó, no obstante, que 'nunca' admitirán que 'la unión entre personas del mismo sexo se equipare a una celebración del matrimonio y, después de quedar establecida, se asimile a la familia. Matrimonio y familia son instituciones sagradas', subrayó.<br><br> The Ecuadorian Episcopal Conference (CEE) posed to the Constitutional Assembly that it recognize the rights that the Law grants to "stable couples, notwithstanding their sex or sexual orientation," although it ratified that homosexual practice as "incompatible with the life of faith."<br><br> It specified, however, that they will "never" accept that the "union between two people of the same sex will be compared to a celebration of matrimony and, after being established that it will be compared to a family. Marriage and family are sacred institutions," it underscored.

Un tribunal judicial de la región La Libertad dejó libres a los tres policías acusados de haber violado a un joven gay al interior de una Comisaría de la Policía Naciona. La denuncia del hecho la hizo Víctor Vásquez, presidente de la Asociación GLBTI de la Libertad, según lo informado los magistrados Víctor Burgos Mariños y Cesar Ortiz Mostacero, dejaron sin efecto la orden de detención que pesaba contra los policías: Dino Horacio Ponce Pardo, Luís Miguel Quispe Cáceres y Juan Isaac León Mostacero. La Asociación GLBTI informó que este hecho ha impactado negativamente en la comunidad LGTB liberteña, ya que sienten que la ley nos les brinda protección frente a los actos de violencia, por este motivo están solicitando el apoyo de la Defensoría del Pueblo y las organizaciones de DDHH para evitar que este caso quede en la impunidad.

HAVANA, Feb 27 (IPS) - The discrimination that people living with HIV face on a day-to-day level in the Caribbean results in frequent violations of their basic rights and is a major hurdle to the implementation of anti-AIDS programmes, say U.N. officials.<br><br> "Prejudice based on religious, social or other reasons are exacerbated when HIV is thrown into the mix. This is one of the big obstacles to the fight against AIDS in the Caribbean and the rest of the world," Miriam Maluwa, representative of UNAIDS for Jamaica, Cuba and the Bahamas, told IPS.

MANILA, Philippines -- A leftist lawmaker on Thursday called on gays and lesbians in Congress to "come out" and push for the passage of the anti-discrimination bill.<br><br> "Siguro kung lalabas sila at sila mismo ang mangunguna sa pagtutulak ng bill na ito, baka may pag-asa pa yung bill [Maybe if they come out and they themselves lead the passage of this bill, maybe there is still hope for the bill]," Bayan Muna (People First) Representative Teddy Casiño said at a news forum, as he noted that gay and lesbian lawmakers "are not on the forefront in pushing for the bill."<br><br>Members of gay and lesbian groups echoed Casiño's call, saying the "climate of stigma" in the Congress has prevented lesbian and gay lesbian legislators from speaking in favor of the bill.

"Until Jamaica addresses the epidemic of homophobic violence, it will have no hope against this epidemic," she said. "If the Jamaican government is serious about fighting the country's AIDS epidemic, it should stop promoting brutality against gay men and lesbians and start protecting them from abuse."<br><br> Jamaican anti-sodomy laws, some believe, target gays specifically. Too many Jamaicans think HIV/AIDS is exclusively an affliction of gay men, Schleifer said, and approve of brutal attacks on gays. Some Jamaican musicians, such as the dancehall performer Beenie Man, have been criticized for lyrics that encourage violence against gay men.

Harvey, 30, was found dead early in the morning of November 30. According to Jamaican police, at least four assailants forced their way into Harvey?s home when he returned from work around 1 a.m. They tied up Harvey and two people staying with him, stole a number of their possessions, and abducted Harvey in the company car. Harvey was found with gunshot wounds in his back and head in a rural area miles from his home.

Jamaica: Treatment of homosexuals by society and government authorities; availability of support services (2004 - 2006)<br><br>In November 2005, Steve (also known as Lenford) Harvey, a prominent Jamaican activist working with gay and lesbian HIV/AIDS sufferers, was abducted and murdered (HRW 1 Dec. 2005) "allegedly because of his homosexuality" (AI 23 May 2006). According to the United States (US) Department of State, the Jamaican police appointed a political ombudsman to oversee an investigation into the murder (8 Mar. 2006, Sec. 5), and a March 2006 news article reported that four men had been charged with his death (Orlando Sentinel 9 Mar. 2006).

DESPITE EFFORTS to reduce stigma and discrimination attached to HIV/AIDS, a recent survey has revealed that 13 per cent of employers would decline to hire an HIV-positive individual.<br><br> The survey, which was conducted by the AIDS Responsibility Project (ARP), led by the Jamaica Employers' Federation (JEF), interviewed 23 companies in 11 sectors in February.<br><br> It was also revealed that 62 per cent of companies have no HIV/AIDS-specific employment policies.

One of the gun men was reported to have said to Mr Harvey and his two house-mates: ?We hear that you are gay?. Two of the men denied it. They were tied up and left in the house. Steve was forced into the car which then sped away. Two hours later, he was found, shot dead.<br><br> Jamaica has one of the highest murder rates in the world. With a population of only 2.7 million people, the country has seen 1,383 murders in 2005 alone. Gun violence is common and homophobia rife.

Discrimination exists with impunity. Under these conditions, the MSM population remains hidden and aloof. Most LGBT people assume a heterosexual lifestyle for public consumption, but pursue same-sex relationships in private. They routinely fail to disclose their orientation to health care providers. As a result, appropriate healthcare cannot be administered, placing the entire public at greater risk of contracting HIV. This project has empowered members of the LGBT community to publicly discuss their orientation and the impact that homophobia has on the gay community and the wider public.
