Law Gives Good Cheer To Queers-The Nepal Supreme Court?s decision to repeal laws discriminating against lesbians, gays and transgender people is momentous, say ARVIND NARRAIN and VIVEK DIVAN- www.tehelka.com 1/11/08 (Sexual Minorities & HIV Status)
DECEMBER 2007 brought some glad tidings for the South Asian gay, lesbian, bisexual and transgender community. In a stunning decision, the Nepal Supreme Court declared that all discriminatory laws against LGBTI (lesbian, gay, bisexual, transgender and intersex) people must be repealed by the government and provision be made for recognition of the human person as not only male or female but also as third gender in terms of citizenship rights based on government documents. The icing on the cake, as it were, was the setting up of a committee by the court to look into whether same-sex marriage would be appropriate taking into account South Asian realities.<br><br>
The decision of the Nepal Supreme Court is momentous (regardless of whether LGBTI people finally will be allowed to marry in Nepal) because it is at odds with the way courts have treated LGBTI concerns in the kindred regions of South Asia.

Sus familiares lo identificaron como Antonio y dijeron que durante el día fue visto con cabello en la colonia donde fue hallado, Santa María la Ribera, cuando visitaba a una tía.

The body of an adolescent aged 17, with homophobic inscriptions written and shaved on his skin was found on the streets of the Cuauhtémoc District of the Federal District.

The naked body had written in the abdomen and one side the words ?I am a fag? and the word ?loca? [in Spanish it also means fag- the literal translation is ?crazy woman?] on the right gluteus. His relatives identified him as Antonio and they said that during the day he was seen with hair in the Colonia Santa Maria La Ribera where he was found, where he had gone to visit his aunt.

Querétaro, Qro. 4 de marzo. Esta mañana se efectuó la primera reunión de la otra campaña con adherentes y simpatizantes de la Sexta declaración de la selva Lacandona en esta ciudad y otras localidades de Querétaro. Los muros y palcos del histórico Teatro de la República retumbaron con las denuncias contra el clima de represión, intolerancia, homofobia y racismo prevalentes en esta ciudad, bastión del panismo y la derecha recalcitrante. Destacó el caso del activista gay Octavio Acuña, asesinado el 21 de junio de 2005, ante lo cual las autoridades queretanas han actuado, por decir lo menos, con negligencia. <br><br> A gathering of "Photo of Victor Camacho" was held in the historic Theater of the Republic in Queretaro, Qro. on March 4. This morning the first gathering of the other campaign with the followers and supporters of the Sixth declaration of the Lacandon Jungle in this city and other places in Queretaro was held. The walls and boxes of the historic Theater of the Republic echoed with the condemnations against the climate of repression, intolerance, homophobia and racism prevalent in this city, bastion of the Pan political party and the recalcitrant right. They highlighted the case of the gay activist Octavio Acuña ,who was assassinated on June 21, 2005, about which the authorities of Queretaro have acted, shall we say, with negligence.

La idea que impera en las instituciones de procuracion de justicia respecto a que se trata de crímenes pasionales debe modificarse porque la pasion no mata y el odio si. Ademas, se culpabiliza a la victima y con ello se genera negligencia de las autoridades reforzada por la falta de mecanismos idoneos para la investigacion. No se si es negligencia, falta de preparacion, simulacion o intencion de no aclararlos por considerarlos insulsos, extern.<br><br>
Califico como lamentable que en la reforma del Estado no se incluya a los crímenes de odio, pues en los ltimos años se han registrado malas integraciones de investigacion. Menciono los casos de la inidgena Ernestina Ascensio, muerta en la region de Zongolica, Veracruz, luego de un presunto ataque sexual perpetrado por militares, y el de las trabajadoras sexuales de la localidad de Castaños, Coahuila, quienes fueron violadas por elementos del Ejercito Mexicano. Hay muchas contradicciones, se perdieron evidencias importantes que hacen imposible el aumento de la sancion.<br><br>
The idea which prevails in the institutions for the procurement of justice regarding crimes of passion needs to be modified because it's not the passion which kills, but rather hate. Besides, the victim was blamed and along with this it generated negligence on the part of the authorities reinforced by the lack of suitable mechanisms for investigation. I don't know if it is negligence, lack of preparation, pretense or the intention of not clarifying them because they are considered tedious.<br><br>
I view it as lamentable that hate crimes are not included in the reform of the government because in the last few years bad investigative integration has occurred. I mention the cases of the indigenous woman Ernestina Ascensio, killed in the region of Zongolica, Veracruz, after a presumed sexual attack perpetrated by soldiers, and that of the sex workers from the town of Castaños, Coahuila, who were raped by elements of the Mexican Army. There are many contradictions, important evidence is lost which makes the increase of punishment impossible.

According to a professor at the Faculty of Psychology of the National Autonomous University of Mexico (Universidad Nacional Autónoma de México, UNAM), homosexuality is not a crime in Mexico (17 May 2006). However, the country has had a long history of [translation] " attacks and murders" of homosexuals and transsexuals (Professor 17 May 2006; see also ILGA 13 July 2005), and members of these communities continue to face discrimination (Mexico 19 May 2006; CEPRODEHI 25 May 2006). Country Reports on Human Rights Practices for 2005 indicated that although the law "prohibits several types of discrimination", including sexual preference, "[h]omophobic beliefs and practices were common, reflected principally in entertainment programs and every day attitudes" (8 Mar. 2006, Sec. 5).

In conclusion, the Organization of Iranian Homosexuals asks all legal organizations to collaborate in defending human rights and the rights of sexual minorities.<br>

Sexual expression in the Islamic Republic is heavily repressed. What impact do restrictions on free expression of sexuality have on society, and how have Iranians responded to government control of their private lives?<br><br>As censored as it is, access to the internet in Iran has shaken up the dynamics of sexual expression. The internet is not just the new way of dating for Iranians (heterosexual, gay, bisexual, and transgender), it is also a source of knowledge for young people who struggle with gender inequality and/or their sexual identity. Recently, a group fighting for the rights of homosexuals in Iran held a human rights conference in Toronto to draw attention to the country's terrible track record and to promote change back at home. Secretary General of the Iranian Queer Organization (IRQO), Arsham Parsi, who fled Iran in 2005, described how he was saved when he began to find sites on the internet about homosexuality. He said the internet is still the primary way IRQO communicates with its 50,000 members, especially with those in Iran.

Information on the situation of homosexuals in Pakistan is scarce among the sources consulted by the Research Directorate. This Response should be read in conjunction with PAK42114.E of 17 October 2003.<br><br>
According to an article published in Hindustan Times, in Pakistan, gay marriages are illegal, and death by stoning is the suggested punishment for anyone found to be engaging in a homosexual act (2 July 2004; see also University of Florida 2003). Similarly, The Boston Globe reported in July 2004 that in Pakistan, homosexuality is a crime that carries the punishment of whipping, imprisonment or death, although no one has been "executed for sodomy in Pakistan's recent history" (11 July 2004).

BEIRUT: Lebanese homosexuals have sought political asylum in the Netherlands to escape their country's tough laws which brand homosexuality an "unnatural" act and to avoid jail at home, Lebanese officials said. Article 534 of the Lebanese penal code "bans unnatural sexual relations" although it does not explicitly refer to homosexuality, the officials in Beirut said.

South Africa/Nigeria: Pink Refugees-Rainbow Network By Adam Levin Planet Syndication 5/7/03 (Sexual Minorities & HIV Status)
First up, Anita is not a woman, but a young Nigerian man called Azubike Udogo, known to his friends as Azu. Azu is currently in the process of applying for refugee status in South Africa on the grounds of his sexual orientation. "I can?t go back to Nigeria," he fumes over a glass of Lemon Twist in his Troyeville apartment. "I'll go somewhere else if I have to. Anywhere. If I go back to Nigeria they'll kill me or they'll throw me in jail and that's it."<br><br>While asylum seekers await judgement, which can take anything up to six years, they live half-lives without ID books or access to bank accounts. Although they are entitled to work, the asylum seeker?s permit must be renewed every three months. Given the transience of this legal status, it is extremely difficult to secure employment or even a lease. But luckily, Azu is a fighter. He has a day job in the call centre of a Randburg attorney?s office, while at night Anita fills the breadbasket. Azu studies French, performs, socialises. Yet, having first presented his case in June 2000, he is, understandably, feeling rather frustrated at this stage.
<br><br>Even in Lagos, Nigerian society is a long way from liberated when it comes to gay rights. While historically it was customary for powerful Hausa men to share their wealth with young male lovers as well as their female harems, in Post-Colonial Nigeria it is almost impossible to be an out homosexual. According to the affidavit of Adolph Mabunda, a young, gay Nigerian in Johannesburg, ?I am regarded as a public disgrace [in Lagos]. At University, I was often insulted by being called derogatory names like [H]?Omo Detergent?. I was rejected and excluded from the mainstream... I am an enemy to my family because they say I have brought shame on them?.
