The gay rights activists who brought the case will now attempt to challenge the rulling in the European Court of Human Rights, and they say they expect to win.

5224.  Jamaica: Minister appeals to persons with HIV/AIDS to get anti-retroviral drugs- JIS News (Sexual Minorities & HIV Status)
THE health minister has appealed to Jamaicans living with the Acquired Immune Deficiency Syndrome (AIDS) to take advantage of the anti-retroviral (ARV) drugs, which the government readily provides for all persons afflicted with the disease.<br> "Some people are afraid to go for it. I am saying to you if you are out there living with AIDS, don't stay at home and die, the drug is available to you," Health Minister Horace Dalley said last week.<br> He suggested that persons who might be hesitant in going for treatment could go to the Jamaica AIDS Support and find someone who would direct them to a clinic, or visit the Ministry of Health, where people are available to speak to them confidentially.<br> "Every single Jamaican who is infected with HIV/AIDS must have access to the drug," said Dalley, while speaking in the House of Representatives.<br> ARVs have been available locally for persons living with AIDS since 2004, and the minister said that last year the National Health Fund (NHF) provided administrative support to the National HIV/AIDS Programme to deliver these benefits to HIV patients.

5225.  Leading Indians urge end of "monstrous" gay sex law- Reuters- By Mark Williams 9/16/06 (Sexual Minorities & HIV Status)
NEW DELHI, Sept 16 (Reuters) - Leading Indian writers, artists, lawyers and academics led by author Vikram Seth have written an open letter urging the government to overturn a British colonial era law that criminalises homosexuality.<br> Condemning Section 377 of the Indian Penal Code as an attack on human rights and fundamental freedoms, it calls for an "archaic and brutal law" to be struck down immediately.<br> The law, formulated in 1861 and currently being challenged in the courts, carries a maximum penalty of 10 years in jail for engaging in gay sex.

EURO-LETTER<br> No. 134 <br> September 2006<br><br> In June 2006, Minister Roman Giertych held a speech in front of the Polish parliament. During this speech he, once again, mentioned the project and hereâ??s what he had come up with this time: â??Campaign Against Homophobia held a camp for children during which they taught about how sex can be changed several times in oneâ??s lifetime; camp, where young boys were dressed up as girls and girls as boys; where visits of German transvestites were organized in Polish kindergarten. â??. Just to get the facts straight â?? participants were adults, we did not have any German participants and the project was about gender stereotypes and discrimination. Roman has a fruitful fantasy. Campaign sent letters to the Commission asking them how to act in such a situation and what do they think about a member stateâ??s Ministry that publicly lies about a Commission programme. We have received no answers until today, the letters were sent in May.<br> As I mentioned before, the Ministry publicly stated that we should be not funded again by this programme. Campaign Against Homophobia applied for a European Voluntary Service project on June 1st, the project would allow a volunteer from Poland work for a Swedish LGBT organization for one year. The decision was supposed to be made on August 4-th; when we checked the results of selection committee, we found that the only project without a decision is ours. The only explanation being: Ministry needs more consultation. Polish National Agency says that itâ??s again out of their hands and the Ministry will make a decision.

Government Must End Repression of Gay People, Groups<br><br> (New York, June 5, 2006) – <br>Recent threats by Polish officials against lesbian, gay, bisexual and transgender individuals and organizations threaten everyone’s basic freedoms, Human Rights Watch said today in a letter to Prime Minister Kasimierz Marcinkiewicz.<br> Last week Poland’s State Prosecutor instructed local prosecutors in five municipalities to launch sweeping investigations into the conduct of “homosexuals” on unspecified allegations of “pedophilia.” Human Rights Watch said that anti-gay actions and comments by numerous officials constitute a pattern of repression in Poland. <br> “Poland’s leaders have stoked the fires of homophobic hatred to advance their political careers,” said Scott Long, director of the Lesbian, Gay, Bisexual and Transgender Rights Program at Human Rights Watch. “The continuing calls to restrict a minority’s basic freedoms threaten the fabric of democracy.”

Most Caribbean leaders rarely speak about AIDS. Many fear the political cost of offending highly conservative, strongly religious societies in which, despite all evidence to the contrary, AIDS is still dismissed as a disease of homosexuals and prostitutes. At the same time, there is a fear that if you talk about AIDS, tourists will not want to come, said Claudette Harry, a Guyanese physician who heads the Pan American Health Organization office in Trinidad. A lot of people come here for sun, sand and sex, and it has the potential to disrupt the market.

Jamaica is not the only country within the region that retains laws criminalising consensual sex between adults of the same sex. Only two English-speaking Caribbean countries do not criminalise this at all: the Bahamas and Turks and Caicos. Here, reports of discrimination and ill-treatment are still common. In July 2003, a Bahamian Bishop threatened to become the first "live Guy Fawkes" if the Government passed legislation legalizing same sex marriage. "The devil and every demon in hell can expect the church to react because God has done too much for us," he reportedly said. Jamaican and Guyanese laws are silent on lesbianism, whilst in Trinidad and Tobago, Barbados and Saint Lucia, all acts of homosexuality are illegal.

5239.  AIDS Stigma in Health Service Provision in the West Indies (Sexual Minorities & HIV Status)
Scott Edward Rutledge, PhD, Florida State University and Neil Abell, PhD, Florida State University.<br> Purpose: AIDS stigma obstructs comprehensive HIV prevention and HIV/AIDS care worldwide, including in the West Indies where national epidemics are growing rapidly. This qualitative research sought to contextualize and compare multilevel appraisals of AIDS stigma in health and social services in Trinidad & Tobago and Grenada. Methods: We conducted eight focus groups (n=51) of people living with HIV/AIDS (PLHA), families and caretakers of PLHA, and health service providers. Using semi-structured group discussions, we explored 1) social constructions of AIDS and PLHA; 2) reaction to PLHA by families, religious groups, and neighbors; 3) conduct toward PLHA by service providers; 4) manifestations of AIDS stigma in service provision or receipt; and, 5) action needed to reduce AIDS stigma. Digitally recorded data were transcribed and then verified by West Indian research associates. In addition, we interviewed 12 key informants from governmental and nongovernmental organizations.

PORT OF SPAIN, May 2 (IPS) - When he was diagnosed with HIV in 1989, Godfrey Sealy, a Trinidad and Tobago playwright and activist, pled with Caribbean policy-makers and the general public not to relegate sex issues to the back burner.<br. "AIDS is about sex. It is the primary means by which people get infected. If we feel we can hide sex from ourselves and our children, we will be encouraging the spread of the virus," he wrote in a newspaper article in September 1989.<br> Now, nearly two decades later, his colleagues and friends are paying respects to the memory of a man who, up until his death last Wednesday at the age of 46, was still fighting to end the stigma that has contributed to the Caribbean's HIV/AIDS rate -- after sub-Saharan Africa, the second highest in the world.
