Hoxha v. Ashcroft (9th Cir. 2003) (United States)
In considering the reasonableness of "well-founded" fear, the Court articulated an inverse relationship between individualized risk and the overall degree of persecution of the group - where the danger is greater for the group, the less personalized risk to the particular applicant needs to be shown.

Melkonian v. Ashcroft (9th Cir. 2003) (United States)
The court found that the Immigration Judge and the BIA erroneously found the petitioner ineligible for asylum in that he had fled his home country for many reasons, including a desire to evade military service and to earn a living to support his family. The Court reiterated that neither purpose makes the petitioner ineligible and that the root cause of flight and of desire to evade military service (i.e., his conscription was based on his ethnicity, religion, and political opinion) was in fact sufficient to demonstrate fear of future persecution. The Court remanded the case to the BIA for consideration of whether the relocation of the petitioner to another area of the home country, Georgia, not controlled by the persecuting Abkhaz group, would be "reasonable" considering all the circumstances.
