Australia is a signatory to the Geneva Convention of 1951 and the 1967 protocol to the convention and uses the Geneva Convention definition of Convention Refugee. Once inside Australia, asylum seekers must apply for a Protection Visa. Those who are found to meet the definition of refugee must also meet certain health and character requirements before they are granted a PV. Upon applying for a PV, most applicants receive a bridging visa provided they arrived in Australia legally. Illegal entrants are compulsorily detained. Some may be eligible for financial assistance and basic health care if it takes more than six months for a decision to be reached on their application. Detainees may be able to obtain application assistance. The Form 866 and Statement of claim are the key written documents in the application for refugee status. It must be completed and filed with the Department of Immigration and Multicultural Affairs (DIMA). This can be done at any time but DIMA anticipates that genuine applicants would lodge as soon as they arrive. Certain penalties apply for application made 45 days after arrival. Decisions are made by a case officer of the DIMA (Department of Immigration and Multicultural Affairs). A decision is normally made on the basis of the written material although some applicants will be interviewed. The interview is defined as non-adversarial, private and confidential. As in other countries, legal assistance in the preparation and presentation of a case has a significant impact on an applicant's chances for success. Negative decisions may be appealed to the Refugee Review Tribunal within 28 days of the decision from DIMA.

Form 886, the key application for a Protection Visa, should be completed as soon as possible after arrival in Australia. It is important that forms be lodged within 45 days of arrival or applicants will not be permitted to work and will lose certain other privileges. As decisions can take upwards of a year or more, the right to work may be an important consideration. In some cases detainees must apply within 2 days of arrival. The form should be completed in as much detail as possible. Applicants will find it difficult to rely on some event or piece of information later if it is not mentioned on the form now. It is better to put in too much information than too little. If you need help completing the form, some assistance can be obtained from officers of the Department of Immigration, your nearest Migrant Resource Centre or from a Migration Agent or solicitor.
